1. Service Description
bloodless.org ("the Service") is a web-based document preparation tool that helps users create blood-related medical directives, commonly known as Durable Powers of Attorney for healthcare decisions involving blood products and related procedures.
2. Jurisdiction Variability
The legal requirements for executing a valid advance healthcare directive vary significantly by state, province, and country. It is your responsibility to:
- Verify that the document format and content comply with your jurisdiction's requirements
- Ensure proper execution (signatures, witnesses, notarization) as required by local law
- Consult with a licensed attorney if you have questions about legal validity
- Keep your directive current and re-execute it if you move to a different jurisdiction
3. No Guarantee of Enforceability
We do not guarantee that any document generated by this Service will be legally enforceable. The enforceability of advance healthcare directives depends on jurisdiction-specific requirements that are outside our control. We provide tools and templates; you are responsible for proper execution and legal compliance.
4. Client-Side Encryption
Your medical directive content is encrypted in your browser before it reaches our servers. This means:
- We cannot read your medical directive content. Only you (or anyone you share your passcode with) can decrypt it.
- If you lose your passcode, we cannot recover your data. This is a fundamental property of the encryption, not a limitation we can override. There is no "forgot passcode" option for your encrypted medical data.
- Your account information (email, name) is stored unencrypted to enable authentication and account management.
- Emergency contact information (healthcare agent name and phone) may be stored unencrypted if you opt in to the emergency QR access feature.
5. AI-Assisted Guidance
This Service includes educational guidance on medical terminology and blood-related procedures, and provides tools to help you get AI feedback on your choices. Regarding these features:
- The guidance explains medical concepts — it does not provide medical advice
- bloodless.org does not connect to any AI service. No data from this app is sent to any AI provider
- Instead, the Service generates privacy-safe prompts that you can copy to your clipboard and paste into your own AI tool (such as ChatGPT, Claude, Gemini, or any other client of your choosing)
- These prompts are constructed entirely in your browser and are never sent to bloodless.org servers
- Prompts exclude all personally identifiable information — no names, dates of birth, addresses, or contact details are included
- Once you paste a prompt into an external AI tool, that interaction is entirely between you and that tool, governed by their terms and privacy policies
- AI does not draft legal text — all substantive legal language comes from reviewed templates
6. OCR Document Upload
If you upload an existing directive for digitization, automated scanning may misread text. You must verify all pre-populated fields before finalizing your document.
7. Account Tiers and Data Retention
- Anonymous: No data is stored on our servers. Everything exists only in your browser for the current session.
- Registered (free): Your encrypted data is stored until you delete your account. You may delete your data at any time.
- Plus / Lifetime: Your encrypted data is stored for the duration of your subscription or indefinitely for lifetime plans. You may delete your data at any time.
- Family Plan: The plan owner manages data for up to 6 family members. All member data is subject to the same retention policy as the plan type.
8. Acceptable Use
You agree not to:
- Create documents for another person without their knowledge and consent
- Impersonate another person or misrepresent your identity
- Use the Service for fraudulent purposes
- Attempt to access other users' encrypted data
- Interfere with the Service's operation or security
9. Limitation of Liability
To the maximum extent permitted by law:
- Our total liability to you for any claims arising from this Service is limited to the amounts you have paid us in the 12 months preceding the claim, or $100, whichever is greater
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- We are not liable for any failure of a medical directive to be honored, recognized, or enforced by any healthcare provider, institution, or jurisdiction
- We are not liable for data loss resulting from a forgotten passcode, as we technically cannot recover encrypted data
- Notification and email delivery (including account alerts, newsletter, and any future emergency notifications) is provided on a best-effort basis. We do not guarantee delivery of any notification or alert. You should not rely solely on this Service for time-critical or emergency communication.
10. Indemnification
You agree to indemnify and hold harmless bloodless.org, its operators, and affiliates from any third-party claims, damages, or expenses arising from your use of the Service, including claims related to the content, validity, or enforceability of documents you create.
11. Third-Party Services
The Service uses the following third-party providers:
- Cloudflare — hosting, content delivery, and data storage infrastructure
- Resend — transactional and newsletter email delivery
- Stripe — payment processing for plus subscriptions
Each provider operates under their own terms of service and privacy policies. We maintain data processing agreements with our infrastructure providers and will execute a DPA with Stripe prior to accepting live payments.
No AI provider: bloodless.org does not connect to any AI service. If you choose to use the AI feedback prompt feature, you copy the generated prompt into your own AI tool — that interaction is between you and the AI provider you choose, not bloodless.org.
12. Changes to These Terms
We may update these Terms from time to time. For material changes, we will provide at least 30 days notice via email (for registered users) or an in-app notification. Continued use after the effective date constitutes acceptance. If you disagree with changes, you may delete your account and data at any time.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms or the Service will be resolved through binding arbitration, with each party waiving the right to participate in a class action.
14. Refund Policy
We want you to be satisfied with your subscription. If you are not, the following refund terms apply:
- Monthly subscriptions: Full refund within 14 days of any charge. After 14 days, you may cancel and your plan will remain active until the end of the billing period — no partial refund is issued.
- Annual subscriptions: Full refund within 14 days of any charge (initial or renewal). After 14 days, cancellation takes effect at the end of the billing period.
- Lifetime purchases: Full refund within 30 days of purchase. After 30 days, lifetime purchases are non-refundable.
- Plan upgrades: Prorated credit is applied automatically by Stripe when switching between plans.
After a refund is processed, your account enters a 30-day grace period during which QR codes continue to resolve and your directives remain accessible in read-only mode. Your documents are never deleted as a consequence of cancellation or refund — they remain available for you to download.
